If a separate policy contains more specific rules for a particular service, promotion or product, the more specific rule applies.

3. Customers and Eligibility

Our website is intended for customers who are legally capable of entering into binding contracts.

If you are a consumer, you must be at least 18 years old or have the consent of a parent or legal guardian where required by law.

By placing an order, creating an account or using our services, you confirm that the information you provide is accurate, complete and up to date.

We reserve the right to refuse, cancel or restrict orders where we reasonably suspect fraud, misuse, inaccurate information, unauthorised use of payment methods, abuse of discounts, automated activity or breach of these Terms.

4. Consumer and Business Customers

A consumer is a natural person who places an order for purposes that are predominantly outside their trade, business or profession.

A business customer is a person, company or organisation acting for commercial, professional or business purposes.

These Terms are primarily drafted for consumer e-commerce sales. Certain consumer-protection rights, including statutory withdrawal rights, may not apply to business customers.

5. Products and Services

The Green Pearl Boutique offers fashion, accessories, lifestyle products and related boutique items through the online shop. The website may also offer or display courses, programmes, editorial content, community features, member content, digital materials, lifestyle content, testimonials and promotional campaigns.

Product images, descriptions, colours, sizes and availability are presented as accurately as reasonably possible. However, colours and product appearance may vary depending on screen settings, lighting, photography and device display.

Product descriptions are for general customer information. They do not constitute a legally binding guarantee unless expressly stated as such.

We may update, change, discontinue or remove products, collections, promotions or website features at any time.

6. Product Availability

All products are subject to availability.

Placing a product in the shopping cart does not reserve the product and does not create a contract. A product may become unavailable before the order is completed.

If a product becomes unavailable after an order is placed, we may cancel the affected item and refund any amount already paid for that item. Where appropriate, we may offer an alternative, replacement, exchange or store credit, but the customer is not obliged to accept an alternative unless legally permitted.

7. Prices, Currency and Taxes

Prices are shown in the currency displayed on the website at the time of purchase.

Unless otherwise stated, product prices do not include shipping costs. Shipping costs, if applicable, are displayed during checkout before the customer places the order.

Additional costs, such as customs duties, import taxes, local taxes, bank fees or currency conversion charges, may apply for international orders. These costs are the responsibility of the customer unless expressly stated otherwise.

Where VAT, sales tax or other taxes apply, they will be handled in accordance with applicable law and the information displayed at checkout.

Prices may change at any time. The price applicable to an order is the price displayed at checkout when the customer submits the order.

8. Price Errors

We make reasonable efforts to ensure that prices are displayed correctly.

If a product is listed with an obvious pricing error, technical error or system error, we may cancel the order or contact the customer to confirm whether they wish to purchase the product at the correct price.

If payment has already been made and the order is cancelled due to an obvious pricing error, we will refund the amount paid.

9. Sale Prices and Price Reductions

Where we advertise a sale, discount, reduced price or percentage reduction, the terms of the specific promotion apply.

For goods offered to consumers in Germany or the EU, price-reduction advertising must be clear and not misleading. Where legally required, a reduction may be shown by reference to the lowest total price applied within the relevant previous period before the price reduction.

We do not artificially increase prices before a promotion in order to create misleading discounts.

Sale items may be limited in quantity, size, colour or availability.

Discounts may not apply to all products unless expressly stated.

10. Order Process

The customer may place products in the shopping cart and proceed to checkout.

Before submitting an order, the customer can review the order details, including products, quantities, price, shipping costs, delivery address and payment method.

The customer is responsible for checking that all order information is correct before submitting the order.

By clicking the final order button, such as “Buy Now”, “Place Order”, “Order and Pay” or equivalent wording indicating an obligation to pay, the customer submits a binding order.

After the order is submitted, the customer may receive an automatic order acknowledgement by email. This confirms receipt of the order but does not necessarily mean that the order has been accepted unless the email or checkout process expressly states otherwise.

A contract is formed when we accept the order, dispatch the products, confirm fulfilment or otherwise expressly accept the order.

We reserve the right to reject or cancel orders in accordance with these Terms.

11. Contract Language and Storage

The contract language is English unless another language is expressly offered.

The customer should save or print these Terms and the order confirmation for their records.

Order details may be made available through the customer account where account functionality is enabled.

12. Payment

Payment providers may apply their own terms, privacy notices, security checks and fraud-prevention procedures.

13. Payment Security

Payments are processed through secure checkout systems provided by Wix and/or third-party payment providers.

We do not normally store full payment-card details. Full card details are usually handled directly by the relevant payment provider.

Customers must not attempt to use unauthorised payment methods, stolen payment data, fraudulent chargebacks or payment manipulation.

14. Retention of Title

Products remain the property of The Green Pearl Boutique until full payment has been received.

This does not affect the customer’s statutory consumer rights.

15. Delivery and Shipping

Delivery options, estimated delivery times, shipping costs and delivery restrictions are displayed on the website, during checkout or in our Shipping and Delivery Policy.

Delivery times are estimates unless expressly stated otherwise. Delays may occur due to stock availability, supplier delays, customs processing, courier delays, incorrect delivery information, public holidays, force majeure events or circumstances outside our reasonable control.

The customer is responsible for providing a complete and accurate delivery address.

If a parcel is returned because of an incorrect address, failed delivery attempt, refusal to accept delivery or failure to collect the parcel, the customer may be responsible for additional shipping costs where permitted by law.

Delivery may be delayed by customs checks or local import procedures.

We are not responsible for delays caused by customs authorities, local postal services or import restrictions outside our control.

17. Returns, Refunds, Exchanges and Withdrawal Rights

Consumers may have a statutory right of withdrawal for online purchases under applicable law.

For customers in Germany and the EU, the statutory withdrawal period is generally 14 days unless an exception applies.

Certain products may be excluded from withdrawal or return rights where legally permitted, for example:

  • customised or personalised products;

  • sealed products that are not suitable for return for health protection or hygiene reasons if unsealed after delivery;

  • products that have been used, damaged or altered beyond what is necessary to inspect them;

  • digital content or services where the customer has agreed to immediate performance and acknowledged the loss of withdrawal rights, where applicable.

Returns, refunds, exchanges, defective products, withdrawal instructions, return conditions and refund timelines are governed by our Returns, Refunds and Exchanges Policy.

Nothing in these Terms limits mandatory statutory consumer rights.

18. Faulty, Damaged or Incorrect Products

If a product arrives faulty, damaged or incorrect, the customer should contact us as soon as reasonably possible with the order number, description of the issue and supporting photos where appropriate.

Customers may have statutory rights in relation to defective goods.

Depending on the circumstances and applicable law, the customer may be entitled to repair, replacement, price reduction, refund or other statutory remedies.

This section does not affect mandatory warranty rights under applicable consumer law.

The website may allow customers to create an account or access a member area.

Customers are responsible for keeping login details confidential and secure.

Customers must not share account access, use another person’s account, create fake accounts or use the member area for unlawful or abusive purposes.

We may suspend, restrict or delete accounts where we reasonably believe that an account has been used for fraud, misuse, spam, harassment, security abuse, fake reviews, discount-code abuse, infringement of rights or breach of these Terms.

Account deletion does not automatically delete order, invoice, tax, accounting or legal records that we are required or entitled to retain.

Member benefits, early access, discounts, loyalty offers, programme access or exclusive content may be changed, suspended or withdrawn at any time unless a specific paid programme states otherwise.

22. Discount Codes, Vouchers and Promotions
